By using our Services, you agree to be legally bound by these Terms.

By accessing or using our services, including financial services, loan applications, support, and communications via SMS or other means, you agree to these Terms. If you are using our services on behalf of a business entity, you affirm that you are authorized to accept these Terms on their behalf.

2. Services overview

American Business Funds provides financial services including loan application processing, account management, account notifications, customer support, and promotional marketing. Services may evolve over time.

We reserve the right to modify, suspend, or discontinue any part of our services at any time.

3. Payments & fees

By using our services, you agree to pay any applicable fees as outlined in your loan or account agreement. Payment terms and interest rates will be detailed within individual contracts or disclosure documents.

Late or missed payments may result in additional interest, penalties, or service suspension as permitted by law.

4. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary, sensitive, or non-public information exchanged during the term of service.

This obligation remains in effect for five (5) years after the termination of the relationship.

5. SMS/text messaging

By submitting your mobile phone number and opting in, you consent to receive SMS/text messages from American Business Funds, including:

• Account-related alerts or service updates
• Responses to your inquiries
• Marketing offers and promotions

Message frequency may vary but will not exceed one (1) message per day. Standard message and data rates may apply.

To opt out of SMS messages, reply STOP. For help, reply HELP or email [email protected]. Consent is not a condition of service.

After you reply STOP, you will receive one confirmation message, and no further SMS messages will be sent unless legally required.

We do not share SMS consent data with third parties for marketing purposes.

6. Intellectual property

All proprietary tools, systems, messaging workflows, and related content developed by American Business Funds remain our intellectual property unless explicitly stated otherwise in writing.

Clients are granted a limited, non-exclusive, non-transferable license to use such content as necessary to engage with our services.

7. Termination

You may terminate services at any time with 30 days' written notice. Upon termination, all outstanding obligations and due amounts must be paid in full.

We reserve the right to terminate service for violations of these Terms or as required by law.

8. Limitation of liability

IN NO EVENT SHALL AMERICAN BUSINESS FUNDS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES arising from service use, including SMS delivery failures.

9. Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States.

Any disputes shall be resolved in courts located in the State of Texas.

10. Changes to terms

We may update these Terms periodically. Updates will be posted on our website. Continued use of services after changes are posted constitutes your agreement to those updates.
